Screen resolution and access times are also recorded to help optimize site performance, identify technical issues, and ensure a seamless user experience across all devices.

By accepting or agreeing to any such agreements, you acknowledge and agree that you are solely responsible for your obligations under them. PTTR shall not be held liable for any claims, disputes, or issues arising from those third-party agreements.

Your Rights and Choices

As a U.S.-based user, you have specific rights under applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and other relevant state-level privacy regulations. In accordance with Cal. Civ. Code § 1798.100 et seq., you have the following rights:

As the broker, you are responsible for choosing which carrier to work with, whether publicly posted or shared via our Private Bidding system. Load Posting and Marketplace Risk

When you post a shipment on PTTR, you retain full control over your freight from start to finish. You have the ability to review bids and choose the broker or carrier that best fits your needs, whether that decision is based on price, timeline, experience, or user ratings. PTTR provides the platform and tools to facilitate these connections, but it does not assign loads or intervene in your decision-making process. It is your responsibility to evaluate all offers and make selections that align with your standards and business requirements.

By using PTTR to post loads, you acknowledge that all freight transactions, including payment, communication, and logistics, take place directly between you and your chosen carrier or broker. PTTR is not a party to any shipping agreement, and we do not guarantee the performance or reliability of any user on the platform. As with any open marketplace, there are inherent risks in engaging with third-party providers. We strongly encourage you to vet participants thoroughly and use the available ratings and reviews to help guide your decision. Your diligence is the key to a successful and secure shipping experience on the PTTR platform.

Privacy Policy for Drayage Services

We take your privacy seriously and aim to provide full transparency regarding how we collect, use, share, and protect your data. This Privacy & Liability Policy applies specifically to users of our Drayage Services and outlines our responsibilities, limitations, and user obligations when using our platform. By using our website and platform, you agree to the terms outlined below.

Information We Collect

When you use PTTR LoadBoard to book or manage drayage services, we may collect the following types of data:

  • Personal Identifiers: Name, phone number, email address, company name, billing details.
  • Shipment Data: Load details, container numbers, BOL/POD documents, port locations, pickup/drop-off times.
  • Geolocation Data: Real-time tracking from port to final destination using GPS-enabled devices.
  • Communication Records: In-platform messages, load updates, time stamps, digital signatures.

This data is used solely to facilitate freight movement, improve service functionality, and enhance platform security.

How We Use Your Data

We use your data to:

  1. Match brokers and shippers with qualified carriers for drayage services.
  2. Schedule port pickups and warehouse deliveries efficiently.
  3. Generate and auto-attach digital BOLs and PODs.
  4. Enable real-time container tracking.
  5. Support communication between brokers, shippers, and carriers.
  6. Maintain a record of completed loads and messages for compliance and audit purposes.
  7. We do not sell your personal or shipment data to third parties for marketing purposes.

Document Security & Access

All documents, including Proof of Delivery (POD), Bill of Lading (BOL), and chassis interchange receipts, are:

  1. Stored securely on our encrypted servers.
  2. Time-stamped and linked to the specific shipment ID.
  3. Accessible only to authorized parties (e.g., shipper, broker, carrier involved in that load).

Users are responsible for maintaining the confidentiality of their platform credentials and for any activity under their account.

Limitation of Liability: Load Resale & Cargo Damage

PTTR LoadBoard does not own, operate, or physically handle any freight listed or booked through our platform. We are a digital logistics facilitation service that connects verified parties.

Therefore

PTTR is not responsible or liable for any loss, damage, delay, misdelivery, or failure in delivery of goods associated with drayage loads, whether caused by the carrier, port operations, equipment malfunction, or other third-party actions.

Specifically

If a load is resold, mishandled, or rerouted by a carrier, broker, or third party, PTTR is not liable for any financial, legal, or material consequences. If goods are damaged, lost, or compromised during drayage, PTTR does not offer compensation, refunds, or insurance coverage for such incidents. All parties engaging in drayage through PTTR LoadBoard do so at their own risk and are encouraged to hold appropriate freight insurance coverage. We provide tools for documentation and visibility, but we are not a legal custodian, shipper of record, or insurer of goods moved via our platform.

User Responsibilities

All users (shippers, brokers, and carriers) must agree to the following:

  1. Provide accurate information regarding loads, container types, time windows, and delivery details.
  2. Use qualified, compliant carriers with port access clearance (e.g., TWIC cards, chassis licenses, reefer-ready).
  3. Promptly update status and documents to avoid delays, fines, or operational issues.
  4. Maintain compliance with all U.S. laws governing drayage transportation, including DOT, FMCSA, and port-specific regulations.

Failure to meet these obligations may result in account suspension, reporting to relevant authorities, and removal from the PTTR LoadBoard system.

Communication & Platform Use

PTTR offers in-platform communication features to streamline operations. While we track messages for quality and compliance:

  1. We are not liable for miscommunication, misunderstood instructions, or any failure resulting from improper use of the messaging tool.
  2. All communication should remain professional and related to active shipments.

We do not monitor message content in real-time and are not responsible for resolving disputes between users unless directly related to platform performance.

Platform Integrity & Technical Limitations

We work hard to ensure the PTTR LoadBoard operates securely and efficiently, but no platform is immune to interruptions. PTTR is not responsible for:

  • Downtime due to maintenance, power outages, or technical failures
  • Errors in GPS tracking caused by signal loss or device issues
  • Delayed or missing digital uploads caused by user-side errors or carrier negligence

We recommend users retain local backups of essential documents for redundancy.

Port & Intermodal Information Disclaimer

Port entry and scheduling processes vary by region and terminal. While PTTR shares best-known practices, we cannot guarantee clearance, access times, or specific gate procedures at any port. It is the responsibility of the carrier or dispatcher to confirm appointment windows, container availability, and required port credentials. PTTR is not liable for demurrage, detention, per diem, or storage fees resulting from late pickups, rejected entries, or expired port holds.

We may disclose personal or shipment data only when required by US law, or:

  • To comply with a court order or legal process.
